Snowdonia is fast becoming the playground for the UK and the rest of Europe. Our team at Hike Snowdonia have known this for years. We are based in the heart of Snowdonia, with our office centred in Capel Curig, arguably the centre of mountaineering in North Wales.
- THESE TERMS
1.1. What these terms cover. These are the terms and conditions on which we supply services to you.
1.2. Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or they require any changes, please contact us to discuss.
- INFORMATION ABOUT US AND HOW TO CONTACT US
2.1. Who we are? We are hike snowdonia, a sole trader established in England and Wales. Our address is Gorphwysfa, Capel Curig, LL24 0EE.
2.2. How to contact us. You can contact us by telephoning 07894686381 or by writing to us at hike Snowdonia, Gorphwysfa, Capel Curig, LL24 0EE or email@example.com
2.3. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
2.4. ”Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
- OUR CONTRACT WITH YOU
3.1. How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
3.2. If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the service. This might, for example, be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the service.
3.3. Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
- INFORMED CONSENT
4.1. The upland environments in the UK can be dangerous. You understand that taking part in hill walking, mountaineering and other adventure activities carries a risk of personal injury or death. You acknowledge that you are aware of these risks and that you are responsible for our own actions.
4.2. Drugs and alcohol. You undertake not to be under the influence of alcohol or other drugs which may impair your ability to safely take part in the activity.
4.3. hike snowdonia limits liability. We accept no responsibility for accidents or injury to you or for the loss of or damage to personal effects, unless caused by our negligence.
4.4. Completion of medical questionnaire. You declare that you will complete and return to us a Medical Questionnaire at least 48 hours before the service takes place. You undertake to advise us of any changes to your health after completion of the Medical Questionnaire. You confirm that you know of no reason which would prevent your participation in the activity.
- CHANGING YOUR BOOKING
5.1. You may be able to change your booking after it has been confirmed. If, after your booking has been confirmed, you wish to transfer it to a different booking or date, we will try and satisfy your requirements; however, this may not always be possible.
5.2. Advise us in writing. You must request any change in writing and this request must be made by the person who made the booking.
5.3. Fees may be charged for amendments. An amendment fee of £25 may be made in-addition to any additional costs associated with the change.
- CANCELLATION OF BOOKING BY YOU
6.1. You may cancel your booking at any time. You must advise us in writing. A cancellation will take place once we receive the written notification. As we incur costs in preparing for and proving you with the service, and in cancelling your arrangements, you will only receive the following refund:
6.1.1. If cancel more than 60 days prior to the start date, then you will be entitled to an 80% refund of the amount paid.
6.1.2. If you cancel 30-60 days prior to the start date then you will be entitled to a 50% refund of the amount paid.
6.1.3. If you cancel less than 30 days prior to the start date then you will not be entitled to a refund.
- WEATHER CAUSING ITINERARY OR ROUTE CHANGES OR CANCELLATION
7.1. You acknowledge that the weather conditions might result in cancellation or change to the planned activities. If in the opinion of the activity leader the weather conditions are such that, in his or her opinion, the advertised route or itinerary may need to change, his or her decision is final and binding. You accept that sometimes it is not possible to make such a judgement until the activity is timed to start or during the activity.
7.2. Change of advertised route or itinerary is not grounds for terminating the contract. Should the leader make a change on the day to the route or itinerary, this will not give rise to a refund. The leader will advise you as to any changes and try and make the day as enjoyable as possible.
7.3. Transfer of booking may be available in certain circumstances. Should the forecasted weather be such that the leader is able to make a decision by 9pm the day before the event starts, that in his or her opinion a material change is required due to weather conditions, we will contact you and offer an alternative itinerary and route. Should you decide that you do not wish to take up this alterative you may transfer your booking to another booking, which is due to take place within 60 days of the start date of the original booking.
- KIT LIST AND MEDICIAL QUESTIONNAIRE
8.1. Failure to have the mandatory kit items will lead to refusal of your participation in the event. It is vital that you have the mandatory kit and that it is in good working condition. Failure to have the mandatory kit may put you and others at risk. If you do not have the correct kit you will not be able to participate in the event. No refund will be payable in such circumstances. You acknowledge that the opinion of the activity leaders as to whether or not you have the mandatory kit is final and binding. You must advise the event leader if you do not have the mandatory kit.
8.2. Failure to complete the Medical Questionnaire within 48 hours of departure time. If you fail to complete the questionnaire, or if answers given indicate that you may not be well enough to take part in the activity, this may give rise to cancellation of your booking. This will be treated as a cancellation by you within 30 days of the event and you will not be entitled to a refund. The decision as to your ability to take part is based solely on the information you disclose. You acknowledge that you will make full and truthful disclosure at all times and advise us of any changes to your situation which may impact on your ability to participate.
- MEETING POINT
9.1. You acknowledge it is your responsibility to get to the starting point in good time. You must make your own arrangements to get to the starting point. If you do not arrive in time you will not be able to participate in the event and will not be entitled to a refund. Unfortunately, we cannot wait for people who are late as they may jeopardise the enjoyment and wellbeing of others on the event.
- HOW WE MAY USE YOUR PERSONAL INFORMATION
10.1. How we will use your personal information. We will use the personal information you provide to us:
10.1.1. to supply the service to you;
10.1.2. to process your payment for the service; and
10.1.3. to give you information about similar services/activities that we provide, but you may stop receiving this at any time by contacting us.
- OTHER IMPORTANT TERMS
11.1. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation or individual. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
11.2. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
11.3. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
11.4. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Welsh law and you can bring legal proceedings in respect of the products in the Welsh courts.
11.5. Where to find the price for the product. The price of the service will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct.
11.6. What happens if we got the price wrong? It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid.
- YOUR RIGHTS TO END THE CONTRACT
12.1. For most products bought online you have a legal right to change your mind within 14 days and receive a refund.
12.2. You have 14 days after the day we email you to confirm we accept your order. However, once we have completed the services you cannot change your mind, even if the period is still running. If you cancel after we have started the services then you must pay any charges we may have incurred up to the date of cancellation (such as banking charges), and you must pay us for the services provided up until the time you tell us that you have changed your mind.
12.3. If you want to cancel within the 14 day period you must tell us you want to end the contract. To end the contract with us, please let us know in writing. Please provide your name, home address, details of the order and, where available, your phone number and email address.
